New England Home Plans grants you, when you purchase a full set of plans, a limited non-exclusive license to build the structure shown in those plans one time, at one location only with the right to have architectural services provided by our exclusive architect HPA Design, Inc. The license also grants you the right to modify that plan, subject to the terms and conditions stated below, to meet specific site, zoning, code, and/or other design needs. This license is granted solely to you as the purchaser and may not be transferred, assigned, sold, or leased. 

Restrictions

All plans purchased from New England Home Plans are protected by United States and international copyright law. It is illegal to reproduce, duplicate, modify, resell, redistribute, lease, loan, and/or develop derivative work, in whole or in part, from the plans without the expressed written consent of New England Home Plans and HPA Design, Inc. The purchase of a full plan set from New England Home Plans grants the purchaser, subject to the license terms, the ability to modify that plan to meet specific site, zoning, code, or other design needs. However, the resulting derivative work remains the intellectual property of the copyright holder. To obtain the right to copy or modify a house plan, you must purchase a PDF Plan Set.  

Your Membership Account

If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. If you are under 18, you may use our website only with involvement of a parent or guardian. nehomeplans.com and its associates reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in their sole discretion. 

Reviews, Comments, Emails, And Other Content

All items purchased from nehomeplans.com are made pursuant to a shipment contract. Any items New England Home Plans physically ships to you are FOB Point of Shipment. This means that the risk of loss and title for such items passed to you upon our delivery of your items to the carrier. 

Product Descriptions

nehomeplans.com attempts to be as accurate as possible. However, nehomeplans.com does not warrant that product descriptions or other content of this site are accurate, complete, reliable, current, or error-free. You may report any product description or other errors found on the site by sending an email to chris@nehomeplans.com. All pre-drawn PDF plans do not carry a stamp from a licensed architect or structural engineer.

NEW ENGLAND HOME PLANS DISCLAIMS ALL WARRANTIES TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING, WITHOUT LIMITATION, THE WARRANTY OF MERCHANTABILITY, NON-INFRINGEMENT OF THIRD PARTIES’ RIGHTS, AND THE WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE. NEW ENGLAND HOME PLANS MAKES NO WARRANTIES AS TO THEIR ACCURACY, RELIABILITY OR COMPLETENESS. These documents could include technical, typographical, and/or other inaccuracies or errors. New England Home Plans assumes no responsibility for errors or omissions in these documents. 
You acknowledge and agree that New England Home Plans does not warrant that its stock plans are buildable on delivery. All New England Home Plans stock plans should be reviewed by a local architect, structural engineer, and/or certified general contractor to verify compliance to local codes, snow loading, seismic and soil conditions, energy requirements, and all other regulations prior to commencing construction. Purchaser assumes all responsibility for any modification made to the plans and agrees not to hold New England Home Plans liable for any problems resulting from the construction, erection, or use of projects produced using plans purchased from New England Home Plans. No modifications by third parties to purchased plans are considered sufficient to remove the plans status as a derivative work for the purposes of Copyright law. 
Some municipalities require a licensed architect’s ‘stamp’ on all plans. HPA Design, Inc., our exclusive architect, can be retained to provide such additional services. Please feel free to contact them for more information at https://architects.hpadesign.com/. New England Home Plans does not offer architectural services in connection with Plans purchased on this website. If the customer wants to retain an architect in connection with a purchased plan, it must contact HPA Design, Inc. and execute a separate agreement for services. You are not authorized to purchase a plan set for use with another architect.  
IN NO EVENT SHALL NEW ENGLAND HOME PLANS, ITS OFFICERS, EMPLOYEES OR PRINCIPALS BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, INCIDENTAL AND CONSEQUENTIAL DAMAGES, LOST PROFITS, OR DAMAGES RESULTING FROM LOST DATA OR BUSINESS INTERRUPTION) RESULTING FROM THE USE OF OR INABILITY TO USE THE CONSTRUCTION DOCUMENTS OR SERVICES PROVIDED BY NEW ENGLAND HOME PLANS, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT NEW ENGLAND HOME PLANS. IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. 

New England Home Plans will not be liable for any loss or damage caused by delay in furnishing construction plans or any other performance under this Agreement. New England Home Plans entire liability and your exclusive remedies for our liability of any kind for the construction plans covered by this Agreement and all other performance or nonperformance by us under or related to this Agreement are limited to replacement of the construction plan set purchased from New England Home Plans. Some states do not allow the exclusion of implied warranties, so the above exclusion may not apply to you. This warranty gives you specific legal rights, and you may also have other rights which vary from state to state. 

Applicable Law

By visiting nehomeplans.com, you agree that the laws of the Commonwealth of Massachusetts, without regard to principles of conflict of laws, will govern these Conditions of Use to the greatest extent possible and any dispute of any sort that might arise between you and nehomeplans.com or its associates. 

Disputes

Any dispute relating in any way to your visit to nehomeplans.com or to products you purchase through nehomeplans.com shall be submitted to confidential arbitration in Massachusetts, except that, to the extent you have in any manner violated or threatened to violate nehomeplans.com intellectual property rights, nehomeplans.com may seek injunctive or other appropriate relief in any state or federal court in the Commonwealth of Massachusetts, and you consent to exclusive jurisdiction and venue in such courts and agree to compensate New England Home Plans for all costs and Attorney’s fees incurred in bringing an action to enforce its intellectual property rights. Arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrators award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.

We reserve the right to make changes to our site, policies, and these Conditions of Use at any time.
